Terms of Service

Summary: QwickEat provides a digital ordering and payment platform for restaurants in Nigeria. By using our platform you agree to these terms. We are not a payment processor — payments are handled by Paystack.

1. About QwickEat

QwickEat is a software-as-a-service platform that enables restaurants to accept digital orders and payments from customers via QR codes. QwickEat is operated by QwickEat NG, Lagos, Nigeria.

By registering as a merchant or using the QwickEat platform in any capacity, you agree to be bound by these Terms of Service.

2. Merchant Accounts

To use QwickEat as a restaurant, you must:

QwickEat reserves the right to approve, reject, suspend, or terminate any merchant account at our discretion, particularly for violations of these terms or fraudulent activity.

3. Platform Fees

QwickEat charges a platform fee on each successful transaction processed through the platform. The current fee is 1.5% of the transaction value. This fee is deducted automatically at the time of payment via Paystack's split payment feature.

There are no monthly fees, setup fees, or hidden charges. Fees are only charged on completed, successful transactions.

Paystack charges their own fees separately. These are governed by Paystack's terms and are not controlled by QwickEat.

4. Payments and Payouts

QwickEat uses Paystack as its payment processor. By using QwickEat, you also agree to Paystack's Terms of Service.

Merchants must connect a valid Paystack subaccount to receive payments. QwickEat does not hold, store, or manage merchant funds. All payments flow directly from customers to merchant Paystack subaccounts.

Settlement timelines are governed by Paystack and the merchant's bank. QwickEat is not responsible for delays in bank settlement.

QwickEat collects limited customer information (phone number, name, optional email) for the purpose of order processing. This data is stored securely and is not sold to third parties. See our Privacy Policy for full details.

Merchants may see customer contact details for the purpose of order fulfilment only. Merchants must not use customer data for marketing without explicit consent.

QwickEat may issue refunds to customers in cases of:

Refunds are processed through Paystack and typically reach the customer within 3–5 business days. QwickEat platform fees on refunded transactions are not returned.

9. Service Availability

QwickEat aims to maintain platform availability at all times. However, we do not guarantee uninterrupted service. We are not liable for losses resulting from platform downtime, network failures, or third-party service outages (including Paystack, Firebase, or hosting providers).

10. Limitation of Liability

To the maximum extent permitted by Nigerian law, QwickEat's liability to any merchant is limited to the total platform fees paid by that merchant in the 30 days preceding the claim. QwickEat is not liable for indirect, incidental, or consequential damages.

11. Changes to These Terms

QwickEat reserves the right to update these terms at any time. Merchants will be notified of material changes via email. Continued use of the platform after changes constitutes acceptance of the new terms.

12. Governing Law

These terms are governed by the laws of the Federal Republic of Nigeria. Any disputes shall be resolved in Lagos State courts.
